LAW ON MASKS IN PUBS

Exemption cards

Those who have an age, health or disability reason for not wearing a face covering should not be routinely asked to give any written evidence of this, this includes exemption cards. No person needs to seek advice or request a letter from a medical professional about their reason for not wearing a face covering.

Some people may feel more comfortable showing something that says they do not have to wear a face covering. This could be in the form of an exemption card, badge or even a home-made sign.

This is a personal choice and is not necessary in law.

On 1 September, health minister Jo Churchill told parliament that the government has been “very clear that there may be people who should be exempt from wearing a covering for a variety of reasons. It is also clear that people do not need to prove it when challenged.”

So, in summary, you can respectfully ask someone to wear a mask, but you should be clear that some people are exempt. If somebody does say they are exempt, you should take their word for it.

RE – MASK EXEMPTION
Dear Landlord
This is what GOV.UK says regarding exemptions

I showed an exemption card.

Under Oath in a court of Law I could prove I am exempt just by showing medical records – I have had a lung operation, I also have other health issues and under employment law I am classed as disabled.
You say you will not allow me in pub it not wearing a mask.
This is discrimination against a disabled person but is a civil matter.

I have a link to a solicitor this is what he says
Supermarkets, shops and public transport providers could face legal action if people with disabilities that stop them from wearing face masks are turned away or refused entry, a leading Public Law Solicitor has cautioned.
The warning comes on the first day that new face covering rules come into force in England and follows growing concerns amongst charities about people with disabilities being confronted while on trains and buses.

I will send a copy to pub owner via email of this document.

Pubs like Wetherspoons minimise Covid risk by fitting plastic screens. Clearly the act of allowing people to drink without a mask means if drinker has covid he could pass it on. I don’t see how virus is active at height but not when sitting. Also masks are only worn to prevent you from passing on covid. No mask on sale says prevents covid – they cant. If people are unwell they should not go out. I would think temperature checks would be much better.
